UNIBEP S.A.
UNIBEP S.A. is a Polish construction company well known in Belarus as the general contractor for construction of the 2nd building of the Victoria 4* hotel in Minsk (the total floor area of the building is 37,699.50 sq.m).
In the course of construction of the hotel, we rendered full legal support of conclusion and performance of the general contract agreement, agreements with subcontractors, etc.
Now we are rendering support to UNIBEP in two major projects in Belarus, one of them is construction of a logistic center with the area of 230 ha in Orsha (Vitebsk region). This is the biggest project for the Belarusian logistic operator called Bremino Group. The second project is construction of a tennis and health-care center in one of Minsk districts. It will be the biggest tennis center in Minsk (13 tennis courts, a fitness center, a sports hall for group sports) with a developed infrastructure (a health-care center, a juice bar, a cafe with the children’s room and a store for sport goods).
A Spanish fashion retailer
Legal support in conclusion of lease agreements, performance of construction works in leased shopping and office premises. The total area of offices and shops is over 20,000 sq.m.
We also were in charge of certain specific issues, for example, for ensuring return of the client’s investments in construction works in the shops and for the accounting and taxation issues associated with that.
A Belarusian manufacturer of doors
In this case, we assisted the client in acquisition of a building with the total floor area of 1,783.5 sq.m located in the historical part of Minsk.
Our functions included legal analysis of documents related to the construction of the deal facility, deal structuring and legal support in concluding and performance of the sale and purchase agreement. We also checked the compliance of the documents related to construction of the building with the specific requirements of the law of the Republic of Belarus on construction in historical parts of Minsk.
The deal structure was complicated with the fact that construction of the building had not been completed by the moment of conclusion of the sale and purchase agreement.

As part of the plant construction project, we advised the client on the required construction permits, which must be obtained from local executive authorities, on the required ecological permits, as well as on performance of turnkey contracts with construction organizations that performed certain works within the scope of the project. Ministry of Natural Resources and Environment Protection of the Republic of Belarus
At present, Arzinger renders legal support to the Ministry of Natural Resources and Environment Protection of the Republic of Belarus within the scope of the international technical aid project for development of wind power engineering in the Republic of Belarus.
The project purpose is to create a set of wind power plants. This is the first international technical aid project in Belarus, which is aimed at developing wind power engineering and is jointly financed by the United Nations Development Program and the Global Environment Facility.
We performed a comprehensive legal audit of construction issues under the project for our client (verification of contracts in the field of construction, proper registration of titles for land plots, verification of the availability the required construction permits, etc.).
A Swiss pharmaceutical company
We render legal support to the client in the scope of the investment project for construction of a plant for manufacturing medical products of human blood plasma in the Republic of Belarus. The expected volume of direct foreign investments is $ 20 million. We advised the client on the issue of the procedure of performing construction works, obtaining the required permits, the issues of the general construction contract agreement. We also advised on specific requirements to manufacturing of medical products.
The project was started in June 2017 and is still ongoing.
Fishman Group
Fishman Group, an Israeli investor, implemented the project for development of the High-Tech Park territory through its subsidiaries SvitLand Development and Devinvest. The client built three residential units (premises in them are rented by the High-Tech Park employees), a shopping mall and a business center with the total area of 44,630 sq.m.
Our team rendered comprehensive legal support of this project, starting with negotiations with local authorities to protect the Investor’s interests under the investment contract and finishing with legal analysis and development of all the documents required for construction.
The investment agreement concluded by the Client for implementation of this project became the third investment agreement in the sovereign history of Belarus.
Belarusian textile manufacturer
Consulting the Client on the issues of eliminating defects within the warranty period under a construction contract and recovery of damages due to the non-quality performance of works on technical supervision within the construction of the facility. The case was complicated due to the fact that the general constructor had been recognized as a bankrupt and according to the law claims of eliminating defects as a non-monetary claims were not subject to satisfaction within bankruptcy proceeding initiated by economic court with regard to the general constructor.

Advicing the Client on the procedure for carrying out repair and restoration works of immovable historical and cultural values and the procedure for obtaining foreign donation for these purposes (as an alternative financing option).
