Procedures for the Performance of Monetary Obligations are simplified in Belarus starting from January 1
The procedures for the performance of monetary obligations are simplified in Belarus according to the Edict of the President of the Republic of Belarus No. 414 “On improving cashless payments” dated October 16, 2018. That’s why an automated information system for the performance of monetary obligations (hereinafter AIS PMO) will be introduced on January 1, 2020.
Amendments to the Law on the Legal Status of Foreign Citizens and Stateless Persons
On December 21, amendments to the Law “On the Legal Status of Foreign Citizens and Stateless Persons in the Republic of Belarus” were published. The document introduced a number of changes aimed at liberalizing the presence of foreigners in the territory of the Republic of Belarus.
The Signed in the Last January Treaty Between the Republic of Belarus and the Republic of Zimbabwe on Mutual Legal Assistance in Civil and Economic Matters was Ratified on October 10, 2019.
Conclusion of the Treaty will enable the competent authorities of the both states to settle issues related to legal assistance in civil and economic matters by fulfilling orders for various legal procedural actions.
On October 23, 2019, the Edict No. 394 “On Provision and Procurement of Loans” was signed. The document regulates microfinance activities.
The Edict approves the List of amendments and alterations to the edicts of the President of the Republic of Belarus, as well as the Regulation on Microfinance Activities. Main innovations include a procedure for creating non-profit microfinance organizations in the form of a consumer cooperative and their business.
The Draft Law “On Payment Systems and Payment Services in the Republic of Belarus” has been Submitted for Discussion
From October 7 to 17, at the initiative of the National Bank of Belarus, a public discussion of the draft Law “On Payment Systems and Payment Services in the Republic of Belarus” was held. The document regulates in detail the obligations of payment service providers and the requirements for information that they must disclose before the conclusion of a payment agreement.
New ways to perform international trade operations
On May 30, 2019 the National Bank of the Republic of Belarus adopted Regulation No. 234 that introduced new ways to perform settlements under international trade operations from the bank accounts not belonging to the importer. From now on, the settlements for the non-resident’s services can be made by withholding by the non-resident company of their remuneration from the sums received from individual users of the services rendered by resident companies (e.g. Booking or Airbnb).
Vacancy of Corporate Secretary is Open
A new position “Corporate Secretary of a joint-stock company” was included in the Unified Qualification Directory of Employees by the Resolution of the Ministry of Labour and Social Protection of the Republic of Belarus No. 20 dated May 4, 2019. Previously, the position of Corporate Secretary was provided in the template of the «Corporate Code of JSC» and «Methodical Recommendations on Corporate Governance in JSC». It mostly concerned companies with a state’s share in share capitals.
Belarusian government increased the limit of maximum revenue for small businesses applying for state support
On May 4, 2019 Council of Ministers of the Republic of Belarus adopted Resolution No. 282. This regulatory act is important for small businesses intending to use state support.
