On 21 May 2023 the Decree of the Ministry of Health of the Republic of Belarus dated 03.05.2023 No. 69 ”On Distance Retail of Medicines“ came into force. The instruction approved by the document (“Instruction No. 69”) lifts the previously existing ban on online trade of pharmaceuticals and sets forth requirements for sellers of such goods as well as for delivery services.
Who has the right to sell medicines online
Online retail of medicines may be carried out only if the following conditions are met simultaneously:
- the seller is a legal entity;
- the seller has a license for pharmaceutical activities in terms of works (services) for the distance retail of medicines;
- the seller has its own website with an online pharmacy.
The State Unitary Enterprise “Gosfarmnadzor” is in charge of the register of entities engaged in distance sales of medicines.
Sellers are required to keep a record of orders and deliveries indicating:
- date, time and order number;
- names of medicinal products and their manufacturers;
- names of pharmaceutical forms;
- time, date and address of delivery.
Which medicines may be sold online
Not all pharmaceuticals may be sold via an online pharmacy. Permission only applies to medicines allowed to be sold without a prescription except for ones with a percentage of ethanol exceeding 25%.
The list of such medicines is established by the Decision of the Ministry of Health of the Republic of Belarus dated 10.04.2019 No. 27.
Requirements for online pharmacies
Although Instruction No. 69 does not qualify an online pharmacy as an online store, the owner of an online pharmacy is also required to provide certain information on their resource. For instance, the home page of an online pharmacy shall contain:
- names, expiry dates, retail prices, storage conditions, instructions for medical use of medicines;
- terms of purchase and payment, methods of payment;
- methods, terms, price and payment conditions regarding delivery;
- conditions, terms and procedure for sale contract termination, including in case the consumer withdraws from the contract prior to the delivery and prepayment for goods and the delivery shall be refunded;
- information on the consumer's rights and the seller's obligations under consumer protection legislation;
- information on the location of the book of complaints and suggestions; phone number, e-mail address of a person authorized by the seller to consider consumers's complaints about the violation of their rights;
- specimens of payment documents confirming the acceptance of cash.
The following information shall be provided on any page on the seller's website:
- full name of the seller (in Russian or Belarusian);
- information on the seller's state registration;
- location, phone number, e-mail address of the seller;
- information about the license for pharmaceutical activity (number and date of issue)
- place of pharmaceutical activities in terms of works (services) for the distance retail of medicines;
- online pharmacy's business hours;
- location, phone number, e-mail address, link to the website of the State Unitary Enterprise “Gosfarmnadzor”.
Pharmaceutical consulting
In addition to processing of orders, pharmaceutical workers have one more obligation, pharmaceutical consulting. When a customer places an order, a pharmaceutical worker shall contact the customer and advise them on the use of medicines. Moreover, the customer shall be informed about the price, expiry date and storage conditions of the medicinal product.
Delivery of medicines
An online pharmacy may choose one of the two ways for delivery, either through its own delivery service (employees) or with the help of an organization providing delivery services.
When engaging a third-party delivery service, sellers shall consider the requirements of the quality assurance system which involves monitoring the contractor's adherence to the following storage and shipping requirements:
- Good Practices for Storage of Medicinal Products approved by the Decree of the Ministry of Health of the Republic of Belarus dated 23.10.2020 No. 88;
- Regulations on Procedures and Conditions for Storage, Transportation, Suspension of Sale and Medical Use, Withdrawal from Circulation, Return to Producer or Supplier, Destruction of Medicinal Products approved by the Resolution of the Council of Ministers of the Republic of Belarus dated 22.12.2009 No. 1677 (“Regulations on Transportation”).
For example, the Provision on Transportation sets a number of requirements for courier service vehicles including the following:
- transportation shall be carried out by a vehicle that ensures safety, integrity, protection from environmental factors, the required temperature regime throughout the transportation (including compliance with the cold chain) in accordance with the conditions specified by the manufacturer of a certain medicinal product;
- vehicles shall be equipped with instruments for measurement of temperature and relative humidity which have passed state verification;
- in case of transportation requiring special temperature storage conditions, the vehicle shall be additionally equipped with thermocontainers or other appropriate equipment.
