The Edict of the President of the Republic of Belarus dated March 25, 2022 No. 120 (hereinafter referred to as the Edict No. 120) amended and supplemented by the Edict of the President of the Republic of Belarus dated January 14, 2014 No. 26 “On measures to improve construction activities”.
The main innovations, which will come into force three months after the official publication of this Edict, are as follows:
- Development and approval of pre-design (pre-investment) documentation will be required not only for the construction, reconstruction and restoration of construction facilities, but also for major repairs, technical modernization, urban landscaping, demolition of facilities.
- Prior to the development of design documentation for the construction, reconstruction, restoration, major repairs, technical modernization, urban landscaping, demolition of facilities, the customer (real estate developer), unless otherwise established by the President of the Republic of Belarus, the customer (real estate developer) shall:
- A) appoint a project manager for the construction of the facility from among employees of appropriate qualifications;
or
- B) involve an engineering organization (engineer), including in compliance with the requirements of the legislation on public procurement, based on the planned sources and amounts of funding provided for in the pre-design (pre-investment) documentation.
For reference: An employee can be appointed as project manager only if he has a certificate confirming his qualifications, issued in accordance with the procedure established by the legislation on administrative procedures.
- The requirement to appoint a project manager or engage an engineering organization does not apply to agricultural organizations engaged in own account and resources construction, reconstruction, restoration, major repairs, technical modernization, urban landscaping, demolition of agricultural facilities of the second to fifth complexity classes.
- The Edict No. 120 defines the content of pre-design (pre-investment) documentation for the construction, reconstruction and restoration of facilities classified from 1stto 4thcomplexity class, and also establishes a list of facilities for which it is allowed to develop and approve pre-design (pre-investment) documentation in a reduced volume (in the form of a design assignment): agricultural facilities of the 2nd-4thcomplexity classes, built by agricultural organizations using own resources and funds, facilities for the development of oil fields in terms of the technological complex for collecting and transporting oil, gas and water, etc.
- The procedure of selection of technological equipment by the customer (real estate developer) is determined: technological equipment is selected by the customer (real estate developer) before the development of design documentation at the stage of pre-design (pre-investment) documentation and is determined as part of the investment justification section that establishes the main technological solutions.
If, based on the results of the development of pre-design (pre-investment) documentation, the customer (real estate developer) decides on the expediency and (or) validity of investing in the construction of facilities, pre-design (pre-investment) documentation may be the basis for the customer (real estate developer) to purchase technological equipment for the facility in accordance with the established procedure (including the actual delivery of such equipment to the facility in accordance with the concluded contract and delivery schedule). In case of concluding a construction contract, the purchase of technological equipment is carried out by the customer with its transfer to the contractor in accordance with the schedule for the supply of material resources, which is an integral part of the construction contract.
For reference: For the purposes of this Edict, technological equipment means machines, devices, installations, equipment, including special equipment (tooling), medical equipment used to ensure the implementation of production processes in accordance with the technology and functional purpose of the facility and (or) performing automatic control of technological processes. Technological equipment does not include furniture, inventory, office equipment, special tools, gaming equipment and other related household items necessary for the implementation of specific activities at the created facility.
- The Edict No. 120 also introduced some changes in terms of regulating the construction of residential buildings for citizens registered as in need of improved housing conditions.
