On June 29, 2024, the Council of the EU adopted a number of new restrictive measures targeting various sectors of the Belarusian economy. The stated aim of the new sanctions is to mirror the measures already imposed against Russia in order to prevent the possibility of sanctions circumvention.
Let us look into the main restrictions imposed.
For reference: The new restrictive measures are established by the EU Council Regulation No. 2024/1865, which amended the “Belarusian” sanctions Regulation No. 765/2006. Regulation No. 2024/1865 entered into force on July 01, 2024 and is intended for direct use in all EU Member States.

I. Limitations on exports of goods from the EU to Belarus
Ban on exports to Belarus of goods that could contribute to the enhancement of Belarusian industrial capacities
Under the new regulation, EU persons (including legal entities) are prohibited from selling, supplying, transferring or exporting to any natural or legal person, entity or body in Belarus or for use in Belarus of goods that could contribute to the enhancement of Belarusian industrial capacities. The list of goods subject to this ban is quite broad and includes, inter alia, non-EU products.

The ban does not apply only to goods, but also to the provision of services (including financial assistance), technology, intellectual property, trade secrets related to such goods.
NB! Contracts concluded earlier than July 01, 2024 may continue to be executed until October 02, 2024 (with certain exceptions). Until that date, EU persons may also continue to execute ancillary contracts necessary for the execution of such contracts.
In some cases, the competent authorities of the EU Member States may authorize the supply of goods, related services, technology, etc., despite the prohibition. In particular, the supply of goods or technologies under codes 3917, 8523 and 8536, as well as the provision of related technical or financial assistance, may be authorized if it is necessary for the purposes of maintenance or repair of medical devices.
Ban on exports of luxury goods to Belarus
A ban has also been introduced on the sale, supply, transfer, export to any natural or legal person, entity or body in Belarus or for use in Belarus of luxury goods, regardless of their county of origin. In particular, the ban includes the following items:
- certain electrical (electronic) or optical equipment for sound and image recording and reproduction of a value exceeding EUR 1,000, including sound, video, photographic equipment, reception apparatus for radio-broadcasting, cinematographic cameras and projectors (Combined Nomenclature codes ex 8519 00 00, ex 8521 00 00, ex 8527 00 00, ex 8528 71 00, ex 8528 72 00, ex 9006 00 00, ex 9007 00 00);
- certain vehicles for the transport of persons on earth, air or sea of a value exceeding EUR 50,000 each, teleferics, chairlifts, ski-draglines, traction mechanisms for funiculars, motorbikes of a value exceeding EUR 5,000 each, as well as their accessories and spare parts (codes ex 4011 10 00, ex 4011 40 00, ex 4011 90 00, ex 7009 10 00, ex 8411 00 00, ex 8512 20 00, ex 8512 30 10, ex 8512 30 90, ex 8603 00 00 00, ex 8605 00 00 00, ex 8607 00 00, ex 8702 00 00 00, ex 8706 00 00 00, ex 8707 00 00, ex 8708 00 00, ex 8711 00 00, ex 8712 00 00, ex 8714 00 00 00, ex 8901 10 00, ex 8901 90 00);

The ban applies to goods of a value exceeding EUR 300,00 per item, unless a different threshold is set by the EU Regulation for the goods separately. In addition, the provision of services (including financial assistance), intellectual property, trade secrets related to sanctioned goods is prohibited.
In some cases, the competent authorities of EU Member States may authorize the provision of prohibited goods (e.g., for cultural property on loan in the context of formal cultural cooperation with Belarus).
Other restrictions on exports to Belarus
Regulation No. 2024/1865 also imposes restrictions on the sale, supply, transfer or export to any natural or legal person, entity or body in Belarus or for use in Belarus of the following goods (regardless of whether they are of EU origin or not):
– certain maritime navigation goods and technology;
– certain goods and technology suited for use in oil refining or natural gas liquefaction.
Please note that certain restrictions are subject to transitional periods.
II. Restrictions on imports of goods to the EU from Belarus
Ban on imports from Belarus of various goods that allow Belarus to diversify its sources of revenue
Under the new package of measures, EU persons are also banned from purchasing, importing or transferring into the EU of different kinds of goods, which “allow Belarus to diversify its sources of revenue”, if they originate from Belarus or are exported from Belarus. The ban also applies to the provision of services (including financial assistance) and technology related to the sanctioned goods.

NB! Until October 02, 2024, the prohibition shall not apply to the execution of contracts concluded before July 01, 2024, as well as their ancillary contracts.
In certain cases, the EU Regulation allows the competent authorities of the Member States to authorize prohibited acts. In particular, it is specifically provided that the competent authorities of the Member States may authorize, under such conditions as they deem appropriate, the entry into the EU of a vehicle falling under CN code 8703 (which includes, inter alia, passenger cars), not intended for sale and owned by:
(a) a citizen of an EU Member State or an immediate family member residing in Belarus and driving the vehicle into the EU for strict personal use; or
(b) a citizen of Belarus holding a valid visa or residence permit allowing entry into the EU, who is driving the vehicle into the EU for strict personal use.
Other restrictions on imports from Belarus
There are also restrictions on the purchase, import or transfer of the following goods:
– gold, gold coins, jewelry/other articles made of gold/containing gold/of metal clad with gold, originating in Belarus and exported from Belarus to the EU and/or to a third country/processed in a third country;
– crude oil originating in Belarus or exported from Belarus;
– diamonds and products incorporating diamonds, if they originate in Belarus/have been exported from Belarus to the EU or a third country/of any origin, if they transited via the territory of Belarus.
Please note that certain restrictions are subject to transitional periods.
III. Transit of goods
A ban has been introduced on the transit via the territory of Belarus of a rather large list of goods and technologies exported from the EU (i.e., for example, when exporting sanctioned goods from the EU to Kazakhstan or another country that is not subject to EU export sanctions). In particular, the ban applies to:
- certain dual-use goods and technology;
- certain goods and technology which might contribute to Belarus’s military and technological enhancement or to the development of its defence and security sector;
- industrial equipment under to CN codes 8407 10, 8409 10, 8409 99, 8412 21, 8413 50, 8421 23, 8421 31, 8428 39, 8429 59, 8431 39, 8471 30, 8471 70, 8481 20, 8502 20, 8507 10;
- certain goods and technology suited for use in aviation or the space industry.
IV. Services and software
A ban on the provision of certain types of services (software) to the Republic of Belarus, its Government, its public bodies, corporations or agencies, or to any natural or legal person acting on their behalf or at their direction
It is prohibited to provide the following types of services to the Republic of Belarus, its Government, state bodies, corporations or agencies, as well as to any natural or legal persons acting on their behalf or at their direction:
– accounting services, auditing services, including statutory audit;
– bookkeeping services;
– tax consulting services;
– business and management consulting services;
– public relations services;
– architectural and engineering services;
– legal advisory services;
– IT consultancy services;
– market research and public opinion polling services;
– technical testing and analysis services;
– advertising services.
It is also prohibited to sell, supply, transfer, export, or provide to the Republic of Belarus, its Government, state bodies, corporations or agencies, as well as to any natural or legal persons acting on their behalf or at their direction:
– software for the management of enterprises <*>;
<*> Systems that digitally represent and steer all processes happening in an enterprise, including:– enterprise resource planning (ERP),– customer relationship management (CRM),– business intelligence (BI),– supply chain management (SCM),– enterprise data warehouse (EDW),– computerized maintenance management system (CMMS),– project management software,– product lifecycle management (PLM),– typical components of the above-mentioned suites, including software for accounting, fleet management, logistics and human resources.
– design and manufacturing software used in the areas of architecture, engineering, construction, manufacturing, media, education and entertainment <*>.
<*> Including:– building information modelling (BIM),– computer aided design (CAD),– computer-aided manufacturing (CAM),– engineer to order (ETO),– typical components of above-mentioned suites.
NB! Until 02 October 2024, the above prohibitions do not apply to the provision of services that are strictly necessary for the termination of contracts concluded before 01 July 2024 or ancillary contracts necessary for the execution of such contracts.
The prohibition also does not apply to the provision of certain services:
– which are strictly necessary for the exercise of the right of defence in judicial proceedings and the right to an effective legal remedy;
– which are strictly necessary to ensure access to judicial, administrative or arbitral proceedings in a EU Member State, or for the recognition or enforcement of a judgment or an arbitration award rendered in an EU Member State, provided that such provision of services is consistent with the objectives of the sanctions;
– which are intended for the exclusive use of legal persons, entities or bodies established in Belarus that are owned by, or solely or jointly controlled by, a legal person, entity or body which is incorporated or constituted under the law of an EU Member State, a country member of the European Economic Area, Switzerland or an EU partner country;
– which are necessary for public health emergencies, the urgent prevention or mitigation of an event likely to have a serious and significant impact on human health and safety or the environment, or as a response to natural disasters.
In some cases, the competent authorities of EU Member States may authorize the provision of services despite the prohibition.
Transport services
The EU has imposed restrictions on the transport sector in Belarus. A ban has been introduced on the carriage of goods by road across the EU territory by trailers and semi-trailers registered in Belarus, including if those trailers or semi-trailers are hauled by trucks registered outside Belarus.
Furthermore, EU companies that are 25% or more owned by a Belarusian natural or legal person are prohibited from becoming a road transport undertaking for the purpose of transporting goods by road within the EU, including transit. As of 2 August 2024, a similar prohibition to transport goods will also apply to EU road transport undertakings established after 08 April 2022 with a similar shareholding of a Belarusian natural or legal person.
V. Other measures
Sanctions on the Belarusian energy sector
A separate article sets out the following restrictive measures on the Belarusian energy sector:
– prohibition to acquire or extend participation in Belarusian or foreign legal persons, entities, bodies operating in the energy sector in Belarus (e.g., through share acquisition/increase);
– prohibition to provide financing to any legal person, entity or body operating in the energy sector in Belarus;
– prohibition to create any new joint venture with any legal person, entity or body operating in the energy sector in Belarus;
– prohibition to provide investment services directly related to the above activities.
The energy sector for the purposes of the EU Regulation means the sector of the Belarusian economy covering the following activities (excluding civil nuclear power):
– exploration, production, distribution in Belarus or mining of crude oil, natural gas or solid fossil fuels, fuel refining, natural gas liquefaction or regasification;
– manufacture or distribution in Belarus of solid fossil fuel products, refined petroleum products or gas;
– construction of facilities or installation of equipment, provision of services, equipment or technology for activities related to power generation or electricity production.
A mandatory contractual clause prohibiting re-export to Belarus of certain goods and technology (no re-export to Belarus clause)
When selling, supplying, transferring or exporting certain goods and technology to any third country (subject to certain exceptions), EU exporters are now required to include in contracts a prohibition on re-exportation of such goods and technology to Belarus or for use in Belarus, as well as adequate remedies in case the counterparty breaches this obligation. Goods and technologies covered by this obligation include, inter alia, industrial goods such as machinery and equipment for the manufacture of semiconductor devices or electronic integrated circuits, transistors and semiconductor devices.
The said obligation applies to the following goods and technologies:
- goods or technologies listed in Annexes XVI, XVII and XXVIII to the EU Regulation;
- certain goods from the List of Common High Priority Items
- firearms and ammunition.
If a third-country counterparty has breached the “no re-export to Belarus” contractual clause, exporters shall inform the competent authority of the EU Member State as soon as they become aware of such a breach.
NB! As regards contracts concluded before 01 July 2024, their execution may continue despite the absence of the above contractual clause. Also, this obligation does not affect the execution of contracts relating to goods under CN codes 8457 10, 8458 11, 8458 91, 8459 61, 8466 93.
Additional derogations from sanctions for EU companies to remove control exercised by a sanctioned person
Derogations from the restrictive measures are introduced whereby the competent authorities of EU Member States may authorize otherwise prohibited acts (e.g., unfreezing of funds, provision of services) for EU companies where this is strictly necessary to remove control over such companies by a sanctioned person (e.g., the owner of the EU company) and to ensure that there is no benefit to the sanctioned person (“firewall”). In this way EU companies can continue their business operations.
Additional derogations from sanctions in case of divestment or ceasing operations in Belarus
The Regulation establishes temporary additional grounds when the competent authorities of the EU Member States may authorize derogation from the sanctions prohibitions on import/export of goods/technology or on the provision of certain services if they are strictly necessary for divestment or wind-down of business activities in Belarus.
Secondary sanctions mechanism
The EU Regulation introduces additional criteria on the basis of which the Council of the EU is entitled to add to the blocking sanctions list (i.e., the list of persons subject to EU blocking sanctions) also individuals or legal persons, entities or bodies that significantly undermine the provisions of the EU Regulation (in particular when contributing to the sanctions circumvention), as well as persons associated with them.
Special compensatory mechanism allowing EU persons to recover losses in connection with claims by Belarusian enterprises
Under the new regulation, EU citizens and companies have the right to apply to the competent court of an EU Member State for the recovery of damages, including legal costs, incurred due to claims brought by Belarusian enterprises, bodies and certain other persons in third-country courts in connection with transactions affected by the EU sanctions. The said mechanism is available to EU persons provided that the relevant EU citizen or company does not have other effective access to legal remedies (as reported in the EU Council press release, e.g., under the relevant bilateral investment treaty).
