The Edict of the President No. 323 dated 02.09.2019 (hereinafter – the Edict) amending the order of providing the sponsor support to agricultural organizations (hereinafter– AO) is in force since September 4.It was expected that the duty of large business to sponsor of AO would be defined in the Edict. On the contrary, as Arzinger specialists believe, the Edict defines privileges of voluntary sponsor support of AO instead of imperative duties.
An online service for authenticating a tax residency certificate has been introduced in Belarus
A tax residency certificate is a document that allows to apply the provisions of double taxation treaty of the Republic of Belarus to avoid double taxation. Such a treaty establishes in which state and how taxes are paid on a particular type of income. Belarus participates in 74 double taxation treaties.
Republic of Belarus will Become the Participant of the Singapore Convention on Mediation
The Convention of the UN on the International Settlement Agreements Resulting from Mediation (hereinafter – the Convention) was adopted by General Assembly in December 2018. Despite opening of signing in August 2019, since that time the Convention has been signed (do not confuse with ratification!) by 46 states including the Republic of Belarus. It shall be applied to international settlement agreements resulting from mediation (so-called settlement agreements).

The new edition of the regulation on state representatives in business entities with a state’s participance
The amendments to the resolution of the Council of Ministers No. 694 “On state representatives in management bodies of business entities whose shares are owned by the Republic of Belarus or by administrative-territorial units” from May 16, 2008 entered into force on June 5. Changes in Copyright Regulation
Finally, open license, i.e conclusion of a license agreement between a licensor and a licensee in a simplified manner, got its legal confirmation in the law. 6% of the national GDP will be distributed according to the new rules

In case this law is adopted, it will affect all of us: individuals, private companies and state bodies. However, this law will not apply to the relationships related to personal, family, home and similar use of personal data for non-commercial purposes.

New ways to perform international trade operations
On May 30, 2019 the National Bank of the Republic of Belarus adopted Regulation No. 234 that introduced new ways to perform settlements under international trade operations from the bank accounts not belonging to the importer. From now on, the settlements for the non-resident’s services can be made by withholding by the non-resident company of their remuneration from the sums received from individual users of the services rendered by resident companies (e.g. Booking or Airbnb).
Belarus signed an Agreement with China on mutual recognition of education documents
The agreement was officially published in Belarus on May, 30th. In accordance with the agreement, Chinese education documents will be recognized in Belarus without any additional procedures (and vice versa).
The Supreme Court Clarified Article 33 of the Tax Code to Economic Courts. What’s new?
The Court has formulated the concept of business deal: “the deal (financial operation) must not have signs of artificiality, lack business and economic goal”. The clarifications also contain examples of entrepreneurs’ actions that have no economic ground, because their deals have a sole goal – to minimize taxes.
Vacancy of Corporate Secretary is Open
A new position “Corporate Secretary of a joint-stock company” was included in the Unified Qualification Directory of Employees by the Resolution of the Ministry of Labour and Social Protection of the Republic of Belarus No. 20 dated May 4, 2019. Previously, the position of Corporate Secretary was provided in the template of the «Corporate Code of JSC» and «Methodical Recommendations on Corporate Governance in JSC». It mostly concerned companies with a state’s share in share capitals.
Regulations on sale of state-owned property simplified
On May 10, 2019 the President of the Republic of Belarus signed the Edict No. 169 “On disposal of state-owned property”. The document is aimed at simplifying the procedure of sale of unused state-owned property in the countryside and small towns.
Belarusian government increased the limit of maximum revenue for small businesses applying for state support
On May 4, 2019 Council of Ministers of the Republic of Belarus adopted Resolution No. 282. This regulatory act is important for small businesses intending to use state support.
