Victory in a large construction arbitration in Stockholm
Our firm congratulates Julia Mironchik and Veronika Pavlovskaya on a brilliant victory in a multimillion-dollar construction dispute between a Central European construction company and the subsidiary of a transnational corporation. The dispute arose from the contract based on the FIDIC model construction contract, and was administered by the Arbitration Institute of the Stockholm Chamber of Commerce.

On 12 April 2019, the I Polish-Belarusian Legal-Economic Forum took place in Warsaw. The Center for Legal Studies of Eastern Europe and Central Asia at the University of Warsaw, the Embassy of the Republic of Belarus in the Republic of Poland and the Belarusian State University are among the organizers of the Forum.

The creditors’ demands within the bankruptcy procedure are satisfied in the order prescribed by law.
Reminder on the order principle: the creditors’ demands are enqueued with one of 5 priorities depending on their type. They will be satisfied only after the demands of higher priority will be satisfied in full. The debts under commercial contracts have 5th priority; the pledged obligations have 4th priority. The pledge mechanism is often used by banks when securing that the borrower returns the loaned money, so they usually have 4th priority. Priorities 1-3 are given to the debt before the employees, the state budget, etc.

The seminar was focused on the following key topics: current issues of economic, foreign trade and investment activities in Belarus. The event was organized by the German Chamber of Commerce and Industry (AHK) in Belarus and the German Economy Information Centre.

The meeting took place on March 5th. There were ten questions in the agenda. Some of them are the following: the problems of participance of Belarusian companies in online auctions on Russian commercial e-trading platforms, receipt of EDS and it’s applicability on the largest trading platforms of Russia, the general rules for tender auctions, the uniform application of the EAEU technical regulations.

The deal was closed on January 1, 2019. On January 2 the company got a new brand name "DPM". Alexander Korsak, Dmitry Viltovsky and lawyers Aleksei Mikhailov and Nikolai Gorelik led the project on behalf of CDRL S.A. During the work they cooperated with consultants K&L Gates (Warsaw office).
